FASB, SEC, and OCC Advance U.S. Stablecoin Rules as Capital Moves Ahead of Congress
Between August 18 and 19, U.S. rulemaking for stablecoins advanced on three fronts at once, Europe's MiCA moved into its enforcement phase, issuers made reserve moves on both sides of the Atlantic, and payment rails — stablecoin and bank-ledger — raced in parallel. Macro liquidity turned: Treasury buybacks lifted bitcoin to its highest since June 2 while exchange stablecoin reserves kept shrinking.
Trend One: U.S. Rules Arrive in a Wave; Capital Moves Ahead of Congress
On August 18, FASB proposed allowing stablecoins that meet conditions — direct redemption at the issuer and a stable price anchor — to be classified as "cash equivalents" on corporate balance sheets; secondary-market liquidity alone would not qualify. The same day, the SEC proposed "Regulation Crypto," a tailored securities offering regime for crypto investment contracts: exemptions for token issuances of up to $5 million over four years and up to $75 million over 12 months, plus a safe harbor from "investment contract" treatment, with ongoing reporting requirements and a 60-day public comment window. The proposal landed days after the Senate failed to advance the CLARITY Act; SEC Chair Paul Atkins said legislation remains "indispensable" and that the SEC will keep pushing CLARITY to the president's desk.
On August 19, Comptroller of the Currency Jonathan Gould said at the Wyoming Blockchain Symposium that the OCC will publish final GENIUS Act implementation rules by November and could begin processing stablecoin issuer applications in 2027. The GENIUS Act, signed in July 2025, requires rules from the OCC, Treasury, FDIC and Federal Reserve by January 18; the OCC's 376-page proposal was released in February.
Capital moved in parallel. On August 19, Ripple Prime closed an upsized $275 million private placement of senior unsecured notes for working capital and U.S. expansion — the notes carry a BBB investment-grade rating from KBRA. Ripple Prime, formerly Hidden Road (acquired for $1.25 billion last year), is positioning as a top non-bank prime broker while Congress remains stalled.
Trend Two: Issuers — MiCA Enforcement, Audits, Reserve Diversification
On August 19, Austria's FMA fined Bitpanda €70,000 over white paper and marketing disclosure violations — the first public MiCA enforcement case in Europe. The same day, Circle reported EURC circulation at €400 million, up 100% year over year; Circle attributes the growth to MiCA, which took effect July 1, 2026, enabling regulated firms to use EURC for treasury, settlement and payments — while Tether's USDT exited EU markets. USDC processed $849 billion in July 2026, 62% of all stablecoin volumes.
Reserve transparency moved in parallel. On August 19, Protos reported that Tether completed the audit promised for nearly a decade — performed by KPMG's U.S. arm on Tether International, not on parent Tether Holdings or Digfinex. Protos notes roughly 25% of Tether's balance sheet sits in assets other than cash or cash equivalents, and 13% in volatile assets including precious metals and bitcoin; accounting professor Tyler Menzer said the audit is "uninformative without the financial statements that were provided to KPMG." On August 19, Ethena added a $1 billion FalconX warehouse facility, giving USDe reserves a new yield source and routing on-chain funds into overcollateralized institutional credit markets.
Trend Three: Settlement Rails — Stablecoins and Bank Ledgers Race
On August 18, Visa issued a request for proposal for stablecoin settlement partners supporting multiple stablecoins — after Mastercard acquired BVNK, the startup that had been Visa's settlement partner. The same day, HashKey began settling insurance and trade deals with Hong Kong's first regulated HKD-pegged stablecoin, following an institutional pilot; the stated target is the $49 billion trade corridor between Hong Kong and the UAE. On August 19, HSBC and Standard Chartered executed the first live banking transaction on Swift's 24/7 ledger — a cross-border real-time settlement pilot, an answer from the traditional clearing layer to stablecoins and tokenized deposits.
Network data shows adoption is uneven. On August 19, RWA.xyz data cited by the XRP Ledger Foundation showed 30-day stablecoin transfer volume on XRPL at $4.32 billion (+10%), holders at 82,110 (+36.7%), while the network's total stablecoin market cap fell 3.07% over 30 days to $954.79 million — still up 227% this year from $291.4 million. Ripple's RLUSD holds $898.8 million, a 94% share of XRPL's stablecoin market cap; XRP itself is down 45.47% in 2026.
Trend Four: Macro — Liquidity Turns, Reserves Keep Falling
On August 19, the U.S. Treasury announced it would at least double long-duration bond buybacks to push down yields. Bitcoin rose 7.7% to $69,523, its highest since June 2; 24-hour liquidations reached $1.345 billion across 105,370 traders, $1.191 billion of it shorts. Strategy rose 14%, Coinbase 12%, Circle 12%.
Reserves tell a different story: exchange stablecoin reserves stand near $64 billion, down roughly $16 billion (about -20%) from the ~$80 billion peak at the end of 2025. Treasury data published August 19 showed U.S. federal debt crossed $40 trillion (breaking the mark August 18), adding $3 trillion in one year — the fastest non-pandemic growth on record — and doubling over the past decade. The CBO projects publicly held debt will exceed 106% of GDP (the 1946 record) around 2030 and reach 120% by 2036.
The institutional dividend and the data gap arrived together: rules are being written across FASB, the SEC, the OCC and MiCA enforcement, while exchange reserves contract and the fiscal backdrop keeps Treasury liquidity intervention active.
